MT Supreme Court Upholds Governor’s Ability to Fill Judicial Vacancies

Helena, Mont. – Montana GOP Chairman Don “K” Kaltschmidt released the following statement in response to the Montana Supreme Court ruling that Senate Bill 140 is constitutional, securing Governor Gianforte’s constitutional duty to appoint district court judges and supreme court justices to fill judicial vacancies.

“After a failed attempt by democratic operatives to alter the will of the Montana legislature, it’s great to see that the Montana Supreme Court has come to the obvious conclusion that Senate Bill 140 is in fact, constitutional,” said Chairman Don “K” Kaltschmidt. “Republicans can rest easy knowing that our Governor will have the power to appoint unbiased, objective judges to Montana’s judicial system that will uphold our Constitution and not legislate from the bench.”
