It’s easy to forget that Montana is a border state, but we suffer from problems tied to illegal immigration and human trafficking just like other border states. To help address this, I sponsored and passed House Bill 278 during the 2025 session, which permits Montana law enforcement officers to check immigration status in certain circumstances.
However, a radical group is suing to block the legislation, placing the interests of illegal immigrants and human traffickers above the safety of Americans. I find it frustrating that a law designed to restore a critical tool to the Montana Highway Patrol (MHP) is now the subject of a costly lawsuit.
HB 278 has a simple, limited purpose: restoring balance to our justice system by correcting the impact of a decade-old court ruling, which stopped MHP officers from checking immigration status due to the actions of one individual. The ruling hindered the whole agency’s ability to keep people safe.
HB 278 is narrow and focused. It gives officers the ability to check a person’s immigration status only after a lawful traffic stop has already occurred and only if the individual cannot provide a valid Montana driver’s license, which is widely accepted as proof of citizenship in our state. Crucially, it does not force officers to check immigration status, recognizing that they are professionals who are trained to be efficient with their time.
Criticism of HB 278 is based on fear, not in facts or common sense. The lawsuit covers issues unrelated to HB 278, which are clearly laid out in other statutes. The legislation is simply intended to ensure that officers are not barred from doing the job they are sworn to do.
One MHP officer told me about a time they pulled over a car with four large men and one young girl in the backseat with limited English. Due to the restriction, the officer could not ask questions to gain further information about the situation, about which they still have nightmares.
Sadly, the number of human trafficking cases tracked by the Montana Department of Justice increased by 1,900% from 2015 to 2023. My bill gives officers one more tool to help stop human trafficking, which often goes hand-in-hand with the cartels that fuel illegal immigration.
It’s clear to me that leftist radicals and the Democrats who enable them don’t care about the safety of Montanans. In contrast, Montana Republicans are making our state safer while President Trump makes America safer.
Montana’s law enforcement officers deserve to help keep our state safe. Let’s empower them instead of tying their hands behind their backs — that’s what Montanans voted for when they sent Republicans to Helena.
